Coyote Marketing or any of it's sites or domains User Agreement/Terms Of Use Welcome to the user agreement (the "Agreement" or "User Agreement") for Coyote Marketing or any of it's sites or domains. This Agreement describes the terms and conditions applicable to your use of our products and services. If you do not agree to be bound by the terms and conditions of this Agreement, you are not permitted to access our website, resources, or services. Coyote Marketing or any of it's sites or domains may be used interchangeably throughout this User Agreement. The terms "we", "ours", or "us" may be used interchangeably throughout this agreement and refer toCoyote Marketing or any of it's sites or domains. Except as stated below, all amended terms shall automatically be effective 30 days after they are initially posted on the Site. Copyrighted Materials: This web site, and materials contained within, are subject to the protection of USA and International copyright laws. Licensing Restrictions: Users agree to abide by any and all licensing rules or restrictions that have been created by the owners of the works contained within the Coyote Marketing or any of it's sites or domains websites. Coyote Marketing or any of it's sites or domains does not create or enforce any minimum or maximum sales prices. Any figures presented are only offered as suggested retail prices.
Minimum Age: Services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. You must be AT LEAST 18 years old to access the Coyote Marketing or any of it's sites or domains websites, resources, and services. Liability: In no event shall Coyote Marketing or any of it's sites or domains be liable for any punitive, special, direct, indirect, incidental, or consequential damages, whether arising under contract, warranty, or tort (including negligence or strict liability) or any other theory of liability. Passwords/User ID's: After having paid membership fees, users are granted unlimited access to the Coyote Marketing or any of it's sites or domains websites. Users agree that they will NOT share or distribute their log in information ( Usernames and Passwords) by email, word of mouth, Usenet, Internet or any other method. Coyote Marketing or any of it's sites or domains can, at their sole discretion , terminate membership without notice or refund, any user that shares or distributes login information. Termination: These Terms of Use are effective until terminated by either party. You may terminate these Terms of Use by destroying all copies and installations of products and services obtained from us. The agreement will automatically and immediately terminate without notice should you violate any terms of this agreement. Violating our Terms Of Use, Copyrights, or any of our licensing restrictions, will result in termination of membership, and forfeiture of all reseller licenses, without notice or refund. Users agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding use of the Coyote Marketing or any of it's sites or domains websites. Membership is non-transferable and non refundable. Additionally, users agree to abide by any and all licensing rules or restrictions that have been created by the owners of the works contained within the Coyote Marketing or any of it's sites or domains websites. Violating our Terms Of Use, Copyrights, or any of our licensing restrictions, will result in termination of membership, and forfeiture of all reseller licenses, without notice or refund. Furthermore, Use of this website constitutes acceptance of the Legal Agreement and Terms Of Use. WARRANTEES: Coyote Marketing or any of it's sites or domains makes NO WARRANTEES express or implied and specifically does not warrant FITNESS FOR SPECIFIC PURPOSE or WARRANTY OF MERCHANTABILITY of any product or service. VENUE: The USER expressly agrees that this agreement are to be interpretted and enforced under the laws of the state of South Carolina and of the United States and FURTHER AGREES that the sole and only venue and jurisdiction for any action under the terms of this agreement shall be in the County of Horey and State of South Carolina. USER expressly consents to the personal jurisdiction of State and Federal Courts for said county and state for any and all actions, including injunctive relief, arising under the terms and conditions of this agreement or by use of any software product contained in Coyote Marketing or any of it's sites or domains now or hereafter. Communications from Coyote Marketing or any of it's sites or domains: By joining Coyote Marketing or any of it's sites or domains, you give us permission to contact you periodically via email with regards to your membership. If you wish to no longer receive communications from us, you will need to cancel your membership. Once membership is cancelled, you'll no longer receive any communications from us. If any provision of this agreement is void or unenforceable in whole or in part, the remaining provisions of this Agreement shall not be affected thereby. Coyote Marketing or any of it's sites or domains reserves the right to amend this agreement at any time. Terms Of Use For The Coyote Marketing or any of it's sites or domains Referral Programs If you edit any of our sales material, or create your own, it must first be approved by us. When promoting the Coyote Marketing or any of it's sites or domains referral programs, you must adhere to our strict NO SPAM guidelines as stated below. You must also promote the Coyote Marketing or any of it's sites or domains websites in a legal and ethical manner. You must follow all other terms and conditions as outlined in the user agreement. Failure to do so will result in removal from the program. You are only permitted to register one referral web page per member. You will have the ability to "co-brand" your Coyote Marketing or any of it's sites or domains pages with your name and website address. The website you link to must not have any sort of illegal or improper content. We keep a database of all registrations. Any member who is found linking to an illegal, improper, or any website that SoftwarePak feels is in poor taste or bad judgment, will immediately have their referral webpage terminated without notice, and will not be allowed to create another. These sorts of sites include, but are not limited to, adult sites, IRC Bots, Warez Sites, Pirated Software/Sites, Hate sites, Hack programs and archives. In addition, no member is allowed to link to a Software/ebook membership site that would be considered as competitive to SoftwarePak. If we discover that the "co-branding" privilege is being abused, we reserve the right to discontinue "co-branding". When receiving customer payments through the referral program, you will be paid directly from the customer, not us. You must treat that customer with respect and courtesy at all times. You may not sell or provide the contact information of any subscriber to any third party. You may obtain separate double-opt-in subscriptions on a voluntary basis from a subscriber through your affiliate site so long as opt-in verification is retained and your publication complies with all applicable laws. You may be required to provide proof of opt-in to us upon request, with or without stated reason for the request. Coyote Marketing or any of it's sites or domains maintains a system for complaints for allegations of violations of these rules and reserves sole and exclusive discretion in the investigation, reporting, and discipline of suspected violations of these rules. Any action brought by the Federal Trade Commission or other public prosecutorial agency against a user or affiliate for alleged violations of regulations for internet or mail order sales or commercial email will be automatic grounds for termination of your account. Termination of your Paypal account or other payment services for any reason or failure to make monthly payments as required by your membership will result in termination of your account. You must follow our Anti-Spam guidelines below and those set for in the CAN SPAM ACT of 2003. Failure to follow these guidelines will be cause for removal from the Coyote Marketing or any of it's sites or domains Referral Programs. Terms of Use regarding the Coyote Marketing or any of it's sites or domains referral program are subject to change. Any changes shall be posted here. Coyote Marketing or any of it's sites or domains Earnings Disclaimer Coyote Marketing or any of it's sites or domains makes no suggestions, implications, warranties, or guarantees that by joining this website, or that by following or adhering to any program or information featured anywhere inside this web site or elsewhere, that users will make money. Coyote Marketing or any of it's sites or domains is not responsible for any losses or damages resulting from the use of any product, link, information, or opportunity contained within this web site. Users realize any business has potential risk for loss of capital. Any Coyote Marketing or any of it's sites or domains member/affiliate/user that uses SPAM in any relation with the Coyote Marketing or any of it's sites or domains websites shall have their memberships terminated immediately, will forfeit any affiliate commissions, will be reported to the FTC for the abuse, and will be held both legally and financially responsible for their actions. Coyote Marketing or any of it's sites or domains reserves the right to amend this agreement at any time.
